What Is Surrogacy? (Meaning & Medical Explanation)

IVF (In-Vitro Fertilisation) is a medical term for surrogacy. In this method, an embryo is made in a lab by combining the egg of the planned mother with the sperm of the father. The healthy baby is then put into the uterus of the surrogate, where it will grow normally until birth.

Is Surrogacy Legal in India?

Yes- surrogacy is legal in India, but only under some specific conditions

According to the Surrogacy (Regulation) Act, 2021, only altruistic surrogacy is legal. This means the surrogate mother cannot receive any financial rewards other than basic medical expenses and health insurance coverage.

All types of commercial surrogacy- where payments and profit are involved are strictly banned in India.

The main purpose behind these laws is to protect the honour of a woman and prevent something unfair, and to make sure that surrogacy remains a selfless act of compassion, not a commercial arrangement.

Why Did the Indian Government Ban Commercial Surrogacy?

In 2021, India banned commercial surrogacy to protect women. There were a lot of poor women who were paid to carry kids for other people. This caused:

  • Not being fair

  • Do not pay women to be surrogates.
  • Surrogates can only be close family members, and they have to choose to be one.

Who Is Eligible for Surrogacy in India?

What Is Altruistic Surrogacy?

Altruistic surrogacy is a type of surrogacy in which the surrogate mother does not get paid or get any other financial benefit, other than for medical bills and insurance. She can't get paid, gifts, or other benefits besides those charges.

Indian law says that the surrogate must be a family member of the couple who wants to have a child, like a sister, cousin, or sister-in-law, and that person must agree to be a surrogate out of support, not for money.

Legal & Medical Conditions for Surrogate Mother (India)

  • The surrogate must be a married woman aged 25 to 35.
  • She needs to have at least one healthy child of her own.
  • She can only be a surrogate once in her life.
  • She must be physically and mentally healthy and hold a fitness certificate from a recognised medical board.
  • Before any procedure, she must provide written informed consent.
  • She can't utilise her own eggs; only gestational surrogacy is authorised.

Current Status of Surrogacy in India (2025 Update)

As of 2025, surrogacy in India is legal but is subject to strict rules under the Surrogacy (Regulation) Act, 2021. The 2024 updates strengthened the rules by limiting the use of donor eggs or sperm, which are now permitted only in certain medical situations
